1. Acceptance of Terms

By downloading, installing, or using the Examer AI mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please uninstall the App and discontinue use immediately.

These Terms constitute a legally binding agreement between you ("User," "you") and Examer AI ("we," "our," "us"). We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.

2. App Description

Examer AI is an AI-powered educational mobile application that provides:

• Chapter Weightage Analysis: Mark distribution analysis based on 10+ years of Previous Year Questions (PYQ) data for CBSE, Bihar Board, and other state boards.
• AI VVI Question Predictor: AI-generated predictions of likely exam questions based on historical patterns.
• Adaptive AI Quizzes: Personalized quizzes that adjust difficulty based on your performance.
• Camera Doubt Scanner: Take a photo of any question to receive an AI-generated step-by-step solution.
• 5-Minute Quick Revision: AI-generated concise revision notes for any chapter.
• PYQ Paper Access: Access to 10+ years of previous year question papers organized by chapter.
• Multi-Language Support: Available in Hindi, Hinglish, and English.
• Smart Dashboard: Track quiz scores, IQ ratings, study streaks, and progress analytics.

3. Eligibility

• You must be at least 13 years of age to use Examer AI.
• Users between 13–18 years should use the App under parental or guardian supervision.
• By using the App, you represent that you meet the eligibility requirements.
• We reserve the right to terminate accounts that violate age requirements.

4. User Accounts

• You must create an account to access personalized features. You may sign up using email or Google Sign-In.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information during registration.
• One account per user. Sharing accounts is not permitted.
• You must notify us immediately at examerai26@gmail.com if you suspect unauthorized access to your account.
• We are not liable for any loss or damage arising from unauthorized use of your account.

5. Free & Pro Plans

5.1 Free Plan

Examer AI offers a free tier that includes:

• Chapter Weightage Analysis
• Limited VVI Question Predictions
• Up to 5 AI quizzes per day
• PYQ Paper Access
• Basic Dashboard

5.2 Pro Plan (Paid Subscription)

The Pro plan unlocks premium features including:

• Unlimited VVI Predictions
• Unlimited AI Quizzes
• Camera Doubt Scanner
• Unlimited AI Queries
• Priority AI Processing Speed
• Advanced Analytics

Pro subscription pricing: ₹99/month or ₹799/year. Prices are subject to change with prior notice.

6. Acceptable Use Policy

When using Examer AI, you agree NOT to:

• Use the App for any illegal or unauthorized purpose.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Use the App to cheat during actual examinations.
• Upload inappropriate, offensive, or illegal content through the Camera Doubt Scanner or AI doubt solver.
• Attempt to gain unauthorized access to our servers, databases, or other users' accounts.
• Use automated bots, scrapers, or similar tools to access the App or its content.
• Distribute, reproduce, or resell any content generated by Examer AI without our written consent.
• Misuse the AI features to generate non-educational content.

Violation of this policy may result in immediate account suspension or termination without refund.

7. AI-Generated Content Disclaimer

Important: Examer AI uses artificial intelligence (including OpenAI models) to generate educational content. Please note:

• AI-generated content such as VVI predictions, quiz questions, doubt solutions, and revision notes are for study assistance only.
• AI predictions are based on historical patterns and do not guarantee that specific questions will appear in actual exams.
• We strive for accuracy, but AI-generated content may occasionally contain errors or inaccuracies.
• Examer AI is a supplementary study tool, not a replacement for official textbooks, teachers, or coaching.
• Users should verify important information with official sources and their teachers.
• We are not responsible for exam outcomes based on reliance on AI-generated content.

8. Intellectual Property

• All content, features, functionality, design, logos, and trademarks of Examer AI are owned by us and protected under Indian intellectual property laws.
• PYQ (Previous Year Questions) data is sourced from publicly available board exam papers and is used for educational purposes under fair use.
• AI-generated content created within the App is licensed to you for personal, non-commercial educational use only.
• You may not copy, modify, distribute, or commercially exploit any part of the App without written permission.

9. Payments & Refunds

• All payments for Pro subscriptions are processed securely through Razorpay. We do not store your payment card details.
• Subscriptions auto-renew unless cancelled before the renewal date.
• You can cancel your subscription at any time from Settings → Subscription → Cancel.
• Refunds are processed as per Google Play Store refund policies.
• If you experience billing issues, contact us at examerai26@gmail.com within 7 days of the transaction.
• No refunds for partial subscription periods after cancellation. Your access continues until the end of the billing cycle.

10. Account Termination

• By You: You may delete your account at any time from Settings → Account → Delete Account, or by emailing examerai26@gmail.com.
• By Us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or misuse our services.
• Upon termination, your access to Pro features will cease immediately.
• We may retain anonymized usage data for analytics purposes after account deletion.

11. Limitation of Liability

To the fullest extent permitted by applicable law:

• Examer AI is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability for any claim shall not exceed the amount paid by you for the Pro subscription in the preceding 12 months.
• We are not responsible for any loss, damage, or poor exam performance resulting from reliance on AI-generated predictions or content.

12. Governing Law & Dispute Resolution

• These Terms are governed by the laws of India.
• Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Patna, Bihar, India.
• Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for at least 30 days.
